Privacy Act Statement

5 U.S.C. 552a(e)(3)

Pursuant to 5 U.S.C. §552a(e)(3), agencies are required to provide what is commonly referred to as a “Privacy Act Statement” to all persons asked to provide personal information about themselves, which will go into a system of records (i.e., the information will be stored and retrieved using the individual’s name or other personal identifier such as a Social Security Number).

Authority

The Consumer Financial Protection Bureau (CFPB) has the authority to collect information under the Dodd-Frank Wall Street Reform and Consumer Protection Act Pub. L. 111-203, Title X, Sections 1022 and 1024, codified at 12 U.S.C. 5512 and 5514.

Purpose

The information you provide to the CFPB will be collected and maintained in the CFPB’s Nonbank Registry. The Nonbank Registry collects personally identifiable information, such as names and business contact information (e.g., address, email, phone number) from authorized representatives and attesting executives acting on behalf of nonbanks involved in the offering or provision of consumer financial products or services that are not insured depository institutions or insured credit unions (hereinafter referred to as “nonbanks”). Usernames and passwords are collected for the purpose of creating a Nonbank Registry user account. Additionally, the names and contact information for individuals who submit an email will be maintained within the Nonbank Registry for the purpose of providing guidance and/or assistance in resolving an issue or question.

Routine Uses

The CFPB may share the information we collect from you with other federal, state, local, and government agencies consistent with law and policy, or pursuant to the published Privacy Act System of Records Notice titled, “CFPB.030 - Nonbank Registry.” Finally, certain information collected and maintained in the Nonbank Registry may be shared with members of the public as is in the public interest in accordance with 12 CFR part 1092.

Disclosure

Nonbanks are required to provide personal information of its authorized representative(s) and/or attesting executive(s) as discussed above and pursuant to 12 CFR part 1092. Refusal to provide this information will prevent you from being able to access the Nonbank Registry on behalf of your nonbank and you will not be able to register your nonbank with the CFPB. This means your nonbank might be out of compliance with Nonbank Registry requirements. Noncompliance may result in an enforcement action against your nonbank.
